read the following General Terms and Conditions (GTC) carefully before
placing your order on our website. By placing an order with cod.m you
accept the validity of the following regulations
§ 1 Scope and supplier
(1) These General Terms and Conditions apply to all orders placed in the online shop of cod.m GmbH.(2) The range of goods in our online shop is aimed exclusively at buyers (end customers) who have reached the age of 18.
(3) Our deliveries, services and offers are made exclusively on the basis of these General Terms and Conditions. The inclusion of conflicting General Terms and Conditions of Business of a customer is hereby already objected to.
(4) The contract language is exclusively German.
§ 2 Conclusion of contract
(1) The presentation of goods in the online shop does not constitute a binding application for the conclusion of a purchase contract. Rather, it is a non-binding invitation to order goods in the online shop.(2) By clicking the button "Order now with obligation to pay" you submit a binding offer to purchase (§ 145 BGB).
(3) After receipt of the purchase offer, you will receive an automatically generated e-mail with which we confirm that we have received your order (confirmation of receipt). This confirmation of receipt does not constitute acceptance of your purchase offer. A contract is not yet concluded by the confirmation of receipt.
(4) A purchase contract for the goods is only concluded when we expressly declare acceptance of the purchase offer or when we dispatch the goods to you - without prior express declaration of acceptance.
§ 3 Prices
The prices stated on the product pages include the statutory value-added tax and other price components, excluding the applicable shipping costs.§ 4 Terms of payment
(1) We deliver exclusively against advance payment.(2) Payment can be made either by electronically transmitted invoice and advance bank transfer, by Paypal or by Sofortüberweisung/Klarna.
(3) The goods will only be delivered once we have received the invoice amount in full. If you order by advance bank transfer, we expect your payment within 5 days of receipt of the invoice. Otherwise we reserve the right to cancel the order.
§ 5 Delivery
(1) Unless otherwise agreed, the goods will be delivered from our warehouse to the address provided by you.If delivery to the customer is not possible because the customer cannot be found at the delivery address given by him, although the delivery date was announced to the customer with a reasonable period of notice, the customer shall bear the costs for the unsuccessful delivery.
(2) The goods shall remain our property until the purchase price has been paid in full.
§ 6 Cancellation policy

§ 7 Damage in transit
(1) If goods are delivered with obvious transport damage, please complain about such defects immediately to the delivery person and contact us as soon as possible.(2) Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.
§ 8 Intended use
All products purchased from cod.m may only be installed by technically experienced or trained persons in accordance with the respective operating and installation instructions. cod.m does not accept any liability for installation errors or improper use.§9 Warranty
Purchasers in the European Union have warranty rights for a period of two years from the date of delivery of the goods and may require the repair or replacement of products purchased from cod.m's website if they prove to be defective or not as described. If the goods cannot be repaired or replaced within a reasonable time or without difficulty, you may claim a refund or reduction of the purchase price.If the supplementary performance is carried out by replacement or repair, the purchaser must return the defective or faulty goods to cod.m. The costs of the return shipment are to be borne by the purchaser. In these cases cod.m will bear the costs for the return shipment according to the legal regulations. cod.m will provide the Purchaser with a prepaid shipping label and, if necessary, with further instructions for a safe return shipment. A return shipment organised by the Customer is only possible at the Customer's risk and expense.
In the case of used goods, the warranty period may be shorter than two years. It shall be one year in the case of the purchase of used goods.
§ 10 Liability
cod.m is liable without limitation, as far as the cause of the damage is based on an intentional or grossly negligent breach of duty by cod.m or one of its legal representatives or agents.Furthermore, cod.m is liable for the slightly negligent breach of essential obligations. Material obligations are obligations, the breach of which endangers the achievement of the purpose of the contract or the fulfilment of which enables the proper performance of the contract in the first place and on the observance of which you regularly rely. In this case, however, cod.m is only liable for the foreseeable, contract-typical damage. Cod.m is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
The above limitations of liability do not apply in the case of injury to life, body and health, for a defect after the assumption of a guarantee for the quality of the product and in the case of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
As far as the liability of cod.m is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.
§ 11 Note on the return of batteries/rechargeable batteries
Batteries must not be disposed of with household waste. You can return your old batteries free of charge to the public collection points in your community or wherever batteries are sold. Batteries containing harmful substances are marked with a sign consisting of a crossed-out dustbin and the chemical symbol (Cd, Hg or Pb) of the heavy metal that is decisive for the classification as containing harmful substances.The "dustbin" symbol means: batteries and accumulators must not be disposed of in household waste. The signs under the dustbin stand for:
Pb: Battery contains lead
Cd: Battery contains cadmium Hg: Battery contains mercury.
§ 12 Information on the disposal of electrical and electronic equipment
Electrical and electronic equipment must not be disposed of with household waste. You can take your waste electrical and electronic equipment to one of the municipal collection points free of charge.§ 13 Dispute resolution
cod.m GmbH does not participate in the EU dispute resolution procedure for consumers.§ 14 Final provisions
(1) Should one or more provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.(2) Contracts between us and you shall be governed exclusively by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict of laws rules.
(3) We reserve the right to make changes to our website and terms and conditions, including these Terms of Sale, at any time. Your order will be subject to the Terms and Conditions of Sale in force at the time you place your order, unless a change to these Terms and Conditions is required by law or government order (in which case they will also apply to orders you have previously placed).
